Driving while intoxicated (DWI) and driving under the influence (DUI) both are terms that refer to the act of operating a motor vehicle (or watercraft or aircraft) while physically impaired by the effects of alcohol and/or drugs. It is a serious offense and if convicted, punishment is severe. They include higher insurance costs, significant fines, driver's license suspension, and alcohol assessment and treatment. It does not matter if the drugs are legal or illegal, prescribed or over the counter, it may be considered a DUI/DWI offense if they negatively effect one’s senses or motor skills.  In order to face charges, one must have a blood alcohol content (BAC) of 0.08% or higher. Any DUI or DWI offense is illegal in all U.S. jurisdictions and carries with it harsh penalties, particularly for repeat offenders.
