Driving while intoxicated (DWI) and driving under the influence (DUI) refer to the act of operating a motor vehicle while impaired by the effects of alcohol and/or drugs. It does not matter if the drugs are legal or illegal, prescribed or over the counter, it may be considered a DUI/DWI offense if they negatively effect one’s senses or motor skills.  In order to face charges, one must have a blood alcohol content (BAC) of 0.08% or higher. These are serious offenses is in all U.S. jurisdictions and carry harsh penalties, particularly for repeat offenders.  Similar laws apply to the operation of boats and aircrafts.
